01 Overview

Seya Health ("Seya," "we," "us," or "our") operates seyahealth.com and sells women's-health supplements. Your access to the website and our services is conditioned on your acceptance of these Terms of Service and our Privacy Policy. By browsing the site or placing an order, you agree to be legally bound by them. If you don't agree, please don't use the site.

We do not promise, represent, warrant, or guarantee that you or any other user will obtain any particular or tangible result from our products.

03 Use of our services

• Visitors can view public content, contact us, and place orders without creating an account.
• Customers who create an account can view order history, manage subscriptions, post reviews, and purchase products.
• You are responsible for all activity that happens under your account credentials.
• Products are sold for personal use only. Reselling Seya products requires our express written consent.

04 Products, pricing & shipping

Product descriptions

We work to describe our products accurately, but we don't warrant that every description, image, or detail is complete or error-free. If a product is misrepresented, your sole remedy is to return the unused item.

Pricing & availability

All prices, promotions, and product availability can change at any time without notice. We may correct pricing errors and cancel or modify orders that appear fraudulent or were placed in error.

Shipping

• We currently ship within the United States. [Confirm whether Canada is included at launch.]
• Orders typically take 2–3 business days to process, with delivery expected within 3–8 business days after that.
• Subscription shipments may shift by a few days for operational reasons.
• A domestic parcel is considered lost after 15 business days with no movement. Risk of loss passes to you once the carrier takes possession.
• Replacements for lost or damaged orders are provided at our discretion after we investigate.

05 Refunds & our guarantee

We stand behind our products with a 30-day money-back guarantee on your first order, subject to these conditions:

• You must request a refund within 30 days of your first order.
• The guarantee applies only to products purchased on seyahealth.com.
• It applies to your first purchase of a given product, not to repeat purchases of the same product.
• We may ask you to return the product before issuing a refund.
• Original and return shipping costs may be non-refundable.
• Approved refunds are issued to your original payment method, typically within 10 business days.

06 Subscribe & Save

Seya subscriptions currently ship within the United States. Here's how they work:

Renewal

• Your subscription renews automatically on the cadence you choose, for example every 30 or 60 days.
• Processing and shipment dates may shift by a few days for operational reasons.
• Your first order and recurring orders may be priced differently if a promotion applied to the first order.
• You can change your frequency or products anytime in the "Manage Subscription" area of your account.

Charges & cancellation

• Your subscription continues and charges automatically at each renewal until you cancel.
• There is no separate subscription fee. You are charged only for the product and shipping.
• To skip or cancel a shipment, do so before its processing date through your account. You are responsible for managing your subscription and keeping your account details, including your email, accurate.
• We reserve the right to suspend or terminate a subscription at our discretion.

07 Billing

You are charged applicable local taxes where required. Payments are handled by a third-party payment processor. If a payment method is declined, we may try to reprocess it and may contact you to update your information. An initial card registration may show a temporary pending charge for verification that clears automatically.

08 Your account

When you register, you provide an email address and create a sign-in name and password. You agree to give true, accurate, current, and complete information. Each sign-in name is for one person. You are responsible for keeping your credentials confidential and for all activity under your account.

09 Acceptable use

When using our site, you agree to follow all applicable laws and to not:

• Collect market research for a competitor.
• Post content that infringes intellectual property, or that is threatening, defamatory, obscene, or invasive of privacy.
• Impersonate anyone or misrepresent your affiliation with a person or entity.
• Reverse engineer, decompile, or try to circumvent the security of the site.
• Use automated scraping tools, except for public search engines and non-commercial archives.
• Frame our trademarks or use hidden meta tags with our name without written consent.
• Overload our infrastructure or interfere with the site's operation through viruses, hacking, or similar means.

We may deny access and remove non-compliant content at our discretion.

10 Intellectual property

Everything on the website, including software, text, graphics, images, logos, and audiovisual works, is owned by Seya or its licensors and is protected by US and foreign law. You have no rights to this content except as expressly permitted here. It cannot be sold, transferred, licensed, modified, or publicly displayed without our prior written consent.

The "Seya" name and logo are our trademarks. Using them, including in links, requires our prior written permission. The design and trade dress of the site are protected, and copying or imitating them, including by framing or mirroring, is prohibited.

11 Customer content & reviews

You may post reviews and comments. Seya acts as a passive conduit and may remove content that violates these terms or that we consider offensive, at our discretion.

• Content you post becomes visible to others, with no expectation of confidentiality.
• You are solely responsible for what you post.
• You keep your copyright, but you grant Seya a non-exclusive, royalty-free, perpetual license to use, modify, reproduce, distribute, and display that content for any lawful purpose.

You warrant that your content is original or properly licensed, doesn't infringe anyone's rights, and contains nothing libelous, defamatory, or obscene.

12 Disclaimers & limitation of liability

The website, products, content, and services are provided "as is" and "as available," without warranties of any kind. To the fullest extent permitted by law, Seya disclaims all warranties, including title, merchantability, non-infringement, and fitness for a particular purpose.

• Seya is not liable for indirect, incidental, or consequential damages, lost profits, or business interruption.
• Our total direct liability is limited to the amount you paid to Seya in the three months before the claim arose.
• Some jurisdictions don't allow certain warranty exclusions or liability limits, so parts of this may not apply to you.

We are not responsible for technical inaccuracies or typographical errors and may correct them without notice.

13 Minors

All purchases must be made by individuals who are 18 or older. To register an account, you must be 18 or older, or have the consent of a parent or guardian.

14 Indemnification

You agree to defend, indemnify, and hold Seya and its officers, directors, employees, and assigns harmless from any claims arising out of your breach of these terms, your misuse of our content or services, or your violation of anyone else's rights.

15 Termination

We may restrict, suspend, or terminate your access to the site at any time, for any reason, without prior notice or liability. We may also change, suspend, or discontinue any part of our services without notice.

16 Governing law & dispute resolution

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any claim must be brought within one year of when it arose, or it is permanently barred. [Confirm governing-law state and venue with counsel.]

Binding arbitration

If a dispute comes up, the party raising it will first send written notice describing the dispute and the relief sought. The parties will try in good faith to resolve it within 30 days. If they can't, either party may elect binding arbitration under the Federal Arbitration Act, administered by JAMS. Arbitration takes place in the US county where you live, unless both parties agree otherwise. There is no right to a jury trial or to litigate in court, except for claims that qualify for small-claims court. Seya may seek injunctive relief in court at any time to protect its intellectual property.

Class action waiver

Disputes are resolved individually. You and Seya waive the right to bring or participate in a class action, representative proceeding, or class arbitration, except where the law does not permit such a waiver.

17 SMS messaging terms

These terms apply if you opt in to Seya text messages.

Opt in

You consent to receive recurring automated marketing and transactional text messages (SMS/MMS) at the number you provide. Consent is not a condition of purchase. Message and data rates may apply, and frequency varies.

Opt out

Reply STOP to any message to unsubscribe. You may receive a confirmation. Reply HELP for help, or email us. Email and verbal requests are not valid opt-out methods; use STOP.

Program & support

Messages may cover order confirmations, shipping and tracking, customer support, promotions, and cart reminders. The program is offered "as is." Message delivery depends on your carrier and is outside our control, and we are not liable for delayed or undelivered messages.

Age & prohibited content

You must be old enough to consent under applicable law to use the program. You agree not to send unlawful, harassing, or otherwise prohibited content, or any content referencing protected health information under HIPAA or the HITECH Act.

18 Entire agreement

Our failure to enforce any provision is not a waiver of it. These Terms of Service, together with our Privacy Policy and any policies posted on the site, are the entire agreement between you and Seya, and they supersede any prior understandings. We may update these terms, and it's your responsibility to review them. Continued use of the site after a change means you accept it.
